Failing to allow the father to see his children may expose the custodial parent to losing custody.
Failing to allow the father to see his children may expose the custodial parent to losing custody.
Why
Custody is the child’s right before it is the custodian’s, and visitation is a right of the non-custodial parent, by law or by court order. Repeated refusal to comply with a visitation order is a breach of the duties of custody, and the court may transfer custody as a result.
What to do
- Comply with the visitation order at the set time and place, and document handover and return.
- If there is a serious reason to prevent a visit, apply to the court to vary the order rather than refusing.
